The agreement

The use of this website and the services offered on it by Agilers ("Owner/We/Us/Our") is governed by the following Terms of Service, including all sub-parts, read together with our Privacy Policy.

Accessing the website — directly or through a link — or purchasing anything from us means you've engaged our Service and agreed to be bound by these terms, along with any additional terms referenced here. They apply to every user: browsers, customers, buyers, vendors, and partners alike.

Owner / Us / We: Agilers, as creator, operator, and publisher of the website, together with its employees and affiliates.

You / User / Client: You, as the user of the Website, will be referred to throughout these Terms of Service with second-person pronouns such as You, Your, Yours, or as User or Client. For the purpose of these Terms of Service, the term "User" or "you" shall mean any natural or legal person who person is accessing the Website. The term '"Your" shall be construed accordingly.

Parties: Collectively, the parties to these Terms of Service (the Owner and You) will be referred to as Parties.

Assent and acceptance

By using this website, you warrant that you've read these terms and agree to be bound by them. If you don't agree, please leave the website. We only agree to provide the website and services to you on the basis of your acceptance. Depending on the specific service you book, additional terms may apply, and those form part of the agreement between us.

What Agilers does

This part matters more than people expect, so it comes early.

Agilers is a travel agency. We arrange and sell travel services that are provided by other companies — airlines, hotels, transport operators, cruise lines, tour operators, and insurers. We are not the airline. We are not the hotel.

When you book through us, a contract forms between you and that supplier, governed by their conditions of carriage or booking terms. Our role is arranging the booking, taking payment, and supporting you through it. We're accountable for doing that part properly and we'll answer for our own errors. We aren't accountable for the supplier's performance, and that distinction shapes most of what follows.

We reserve the right to refuse service or decline a booking at our discretion, to anyone, for any reason, at any time.

Bookings and confirmation

A booking isn't confirmed when you submit an enquiry or a form. It's confirmed when we send you written confirmation with a booking reference, and only after your payment has cleared.

Availability and pricing come from live supplier feeds and can shift between the moment you search and the moment you pay. Occasionally a supplier declines a booking after we've taken payment. When that happens, we'll offer an alternative or refund you in full, and that's the limit of our obligation.

Check your confirmation the day it arrives. Names must match passports exactly, and dates, routes, room categories, and inclusions all need to be right. Tell us about an error within 24 hours and we'll fix what's fixable. After that, the supplier's amendment rules take over — and airline name corrections are frequently treated as cancellations with full loss of fare.

Payment and fees

Prices are quoted in Indian Rupees unless stated otherwise and include GST at the applicable rate. The final amount payable is shown to you before you complete the purchase.

Unless your quotation says otherwise, these aren't included: visa fees, travel insurance, airport transfers, meals not listed in the inclusions, tips, resort fees payable at the property, excess baggage, and personal expenses.

Prices can move after booking in a few situations — a fuel surcharge imposed by an airline, currency movement on foreign-currency components, a government tax revision, or a supplier repricing an unconfirmed element. We'll tell you before anything is charged. Where an increase exceeds 10% of the total, you may cancel and receive back everything paid, minus amounts already committed to suppliers and not recoverable.

Payment terms depend on the product. Flights are usually payable in full at the time of booking. Packages typically need a deposit with the balance due before departure, as specified in your quotation. Miss the balance date and the supplier may cancel, which triggers their cancellation charges. Those are yours to bear.

Your responsibilities as a traveller

Passports, visas, and health requirements are the traveller's responsibility. We'll advise you as accurately as we can and we'll process visa applications where you've engaged us to do so. But entry rules change without notice and they're enforced by governments, not by us.

Please verify for yourself that:

  • Your passport is valid for at least six months beyond your return date and has enough blank pages
  • Transit visas are in order for every connection, including airside ones, which catch people out regularly
  • Vaccination and health documentation meets destination requirements
  • The name on every ticket matches the name on the travel document
  • Denied boarding or refused entry for any of these reasons isn't refundable, by us or by the supplier.

You also agree to behave reasonably while travelling. Suppliers can remove passengers who are disruptive, intoxicated, or non-compliant with safety instructions. If that happens, your trip ends there, with no refund and no obligation on us to arrange your return.

Changes and cancellations

Charges follow the supplier's rules, plus our service fee. Many airfares and most promotional hotel rates are fully non-refundable from the moment of issue. We'll always set out the cancellation terms before you commit. Full detail is in our Refund Policy.

Where a supplier makes a significant change — a rescheduled flight, an overbooked hotel, an altered itinerary — we'll pass it on as soon as we hear and help you decide whether to accept the alternative, take a different option, or cancel. Compensation in these cases comes from the supplier, under their policy and timeline. We'll pursue it on your behalf. What we can't do is pay it ourselves when the supplier refuses.

Travel insurance

Insurance isn't mandatory, but travelling internationally without it is a bad bet. Medical evacuation from a remote destination can run into tens of lakhs. We strongly recommend cover for medical expenses, cancellation, baggage, and personal liability. Buy it through us or arrange it yourself — just have it. If you decline cover and something goes wrong, the cost is yours.

License to use the website

We may provide you with documentation, data, itineraries, and other material developed by us ("Owner Materials"). We grant you a non-exclusive, limited, non-transferable, revocable license to use these solely in connection with your use of the website and our services. They may not be used for any other purpose, and the license ends when you stop using the website or when these terms terminate.

You agree not to collect contact information of other users, or copy information by unsolicited access, for any purpose. Any unauthorized use terminates the license granted to you, and you agree not to bypass any measure we use to restrict access.

Intellectual property

The website and all services provided by Agilers are our property, including copyrights, trademarks, trade secrets, and other intellectual property. You agree not to reproduce or distribute any of it — electronically or through registration of new trademarks, trade names, service marks, or URLs — without our express written permission.

Acceptable use

You agree not to use the website or services for any unlawful purpose, or in any way that could damage the website, the services, or our business.

You further agree not to use the website:

  • To harass, abuse, threaten, defame, or discriminate against anyone
  • To infringe the intellectual property, publicity, or privacy rights of Agilers or any third party
  • To upload viruses or malicious code
  • To perpetrate fraud, or to submit false or misleading information
  • To run unlawful gambling, sweepstakes, or pyramid schemes
  • To publish obscene, defamatory, or unlawful material, or content that incites violence, hate, or discrimination
  • To collect or track other people's personal information
  • To spam, phish, spider, crawl, or scrape
  • To overburden or impair the website, or interfere with its security features
  • To make speculative, fraudulent, or duplicate bookings

We may terminate your use of the service for any of the above. We have the right, though not the obligation, to review, edit, or remove content posted by users where we consider it unlawful or objectionable. You're solely responsible for anything you post and you confirm you have the right to make it available.

Communication

By agreeing to these terms, you consent to receive communication from us by phone, email, and electronic record — including messages about the services you've selected, booking updates, and information about products offered by Agilers and our partners. Notices posted on the website also count as communication. You agree that messages sent to you by us won't be treated as spam under any applicable law.

Sale of goods and services

The Owner does not accept responsibility for the security of Your account or content. You agree that Your use of the Website or Services is at Your own risk.

INDEMNIFICATION

We try to be as accurate as possible in describing the services on this website. Even so, we don't guarantee that every product description, image, or inclusion is free from error, and you acknowledge that you purchase at your own risk.

For services provided by third parties, we make no warranty as to quality, fitness, safety, or legality. Any claim you have against a supplier should be pursued directly with that supplier, not with us.

Prices and descriptions may change at any time without notice. We may limit or cancel quantities purchased per person or per order, restrict sales to any region or jurisdiction, and refuse orders that appear to be placed by resellers or distributors. If we cancel an order, we'll contact you using the email or phone number given at the time of booking.

We take care to display images accurately, but we can't guarantee your screen renders colour correctly.

Where we provide access to third-party tools, we do so "as is" and "as available", without warranty or endorsement. Using them is at your own discretion, and you should satisfy yourself with the terms of the relevant provider.

Third-party links and content

We may post links to third-party websites or services. We aren't responsible or liable for any loss or damage arising from your use of them.

Disclaimer of warranties

Your use of the website and services is at your own risk, and everything we provide is on an "as is" and "as available" basis. We expressly disclaim all express and implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We make no warranty that the website will be uninterrupted, timely, secure, or error-free, nor that any defect will be corrected. We assume no responsibility for the accuracy, currency, or completeness of information, views, or advice contained on the website, including material supplied by third parties.

Incorrect information is occasionally published inadvertently — typographical errors, pricing inaccuracies, or omissions relating to descriptions, promotions, offers, or availability. We may correct these at any time and may cancel an order if any information was inaccurate, including after you've submitted it. We're under no obligation to update information except where the law requires it.

While we've made reasonable efforts to secure the website, we can't represent that it's impervious to unauthorized access. We aren't responsible for unauthorized access to or alteration of your transmissions or data, or for messages purporting to come from us that we didn't authorize.

We have no liability and will make no refund in the event of delay, cancellation, strike, force majeure, or other causes beyond our direct control, and we bear no responsibility for additional expenses arising from the acts or omissions of any government or authority.

Limitation of liability

To the fullest extent permitted by law, we're not liable for any direct, indirect, punitive, incidental, special, or consequential damages arising from your use of the website or services. That includes lost profits, lost revenue, lost data, missed business opportunities, and damages arising from delay or inability to use the site.

Where we're found liable despite the above, our total liability in connection with any transaction will not exceed the amount you paid us for the affected booking.

Nothing in this clause limits liability for death or personal injury caused by our negligence, or for fraud, because the law doesn't permit that.

Indemnification

You agree to defend and indemnify Agilers and its affiliates, and hold us harmless, against any legal claims and demands, including reasonable legal fees, arising from your use or misuse of the website or services, your breach of these terms, or your own conduct. We may select our own counsel and participate in our own defense.

You also accept responsibility for any action taken by anyone authorized to use your account, including where you've disclosed your password to a third party.

Service interruptions

We may need to interrupt your access to the website for scheduled or emergency maintenance. Access may also be affected by unanticipated downtime. We have no liability for loss or damage resulting from either.

Term, termination, and suspension

We may terminate these terms with you at any time, with or without cause, and specifically reserve the right to do so if you breach them. If you hold an account, you may terminate by contacting us and requesting it. Outstanding fees remain payable after termination. Any provision that by its nature should survive termination will continue in force.

Modification

We may modify these terms at any time without notice. Modifications take effect immediately on posting and replace prior versions. Please check the effective date at the top and clear your cache so you aren't reading an outdated version. Continued use of the website after a modification means you accept it.

If any part of these terms is held invalid or unenforceable, the prior effective version of that provision will be treated as enforceable to the fullest extent possible.
